A Second Lawsuit, Same Business Park: The 'Data Way' Injury Case

The density fight isn't the only lawsuit tied to the Central Park Commerce Center. A second, very different case is moving through the same Palm Beach County courthouse, and the road at the center of it happens to be named "Data Way."

What the case alleges

In a complaint filed May 27, 2026 (Case No. 50-2026-CA-005925), Adolfo Rosito alleges that on October 8, 2025 he fell into an open, flooded, uncovered drainage hole on "Data Way," a road inside the Central Park Commerce Center, while the development's master association was doing roadway and drainage-system construction. He alleges the association failed to inspect, warn, cover, or maintain the hazard, that he was permanently injured, and he seeks damages above $100,000.

This is a premises-liability case, about whether a property's caretaker kept it reasonably safe. It is entirely separate from the data-center dispute, and nothing in it bears on the merits of the density fight.

Why it belongs in this series

The connection is in who sits on which side. The Central Park Commerce Center Master Association is a plaintiff in the Project Tango density lawsuit, the party doing the suing. In the Data Way case it's the defendant, the party being sued. Same governing entity, opposite ends of the "v." The two cases share only the development, so don't conflate them.

The Data Way complaint does establish one thing in passing: roadway and drainage construction was already underway on the site in late 2025. That's the groundwork a long-approved business park needs, not evidence that a data center is going up. The road's name is a coincidence and nothing more; it says nothing about whether Project Tango wins its county approvals.

As with the density case, this is one side's allegations. The master association's response, its account of the construction, the conditions, and the injury, would come in its own filings. We're describing the complaint, not a finding.
