Arden Strong (https://ardenstrong.org) is a community advocacy coalition operated by residents of the Arden community in Palm Beach County, Florida. This Privacy Policy describes how we collect, use, store, disclose, and protect information we receive from visitors and members of this website. By accessing or using this website, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree, please discontinue use of this website.

1. Information We Collect

We collect information you provide directly to us and information generated automatically through your use of the website.

1.1 Petition and Account Information

When you sign the petition, create an account, or submit any form on this website, we may collect the following:

  • First and last name
  • Email address
  • Phone number (optional)
  • Mailing address, city, state, and ZIP code
  • Home builder and lot or unit number, where applicable
  • Residency status within the Arden community (required for petition)
  • Whether you are an original purchaser or subsequent buyer
  • Password and authentication credentials (for registered accounts)
  • Self-reported information submitted through contact forms or board application forms

1.2 Uploaded Documents

Registered users with petition status or verified claimant standing may upload documents to the platform. We collect and store the files themselves (PDFs, images, and other permitted formats), their associated filenames, upload timestamps, file sizes, document titles, descriptions, and any visibility designations (shared or private) you assign to them.

1.3 Automatically Collected Information

When you use this website, we or our third-party service providers may automatically collect certain technical information, including:

  • Device type, operating system, and browser version
  • IP address (used for rate-limiting; we do not store raw IP addresses persistently)
  • Referring URL and pages visited
  • reCAPTCHA signals — we use Google reCAPTCHA v3 to prevent automated spam submissions. reCAPTCHA collects hardware and software information, including device and application data, and sends it to Google for analysis. This data is subject to Google’s Privacy Policy.

We do not use additional third-party analytics services or persistent tracking cookies beyond what is described above.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • Community advocacy: To organize and document community opposition to the proposed Central Park Commerce Center (Project Tango) and related development projects in Palm Beach County, Florida.
  • Legal proceedings support: To compile evidence, records of affected residents, and supporting documentation for use in potential or ongoing legal proceedings, regulatory proceedings, or administrative hearings.
  • Sharing with legal counsel: To share relevant petition and account information with attorneys retained by or on behalf of the Arden Strong coalition for the purpose of case evaluation, legal strategy, and representation.
  • Coalition operations: To manage accounts, authenticate users, process board applications, administer the document hub, and operate the website.
  • Communications: To send confirmation emails, case updates, hearing notifications, newsletter communications, and other coalition-related correspondence. You may opt out of non-essential communications at any time.
  • Security and fraud prevention: To detect, investigate, and prevent fraudulent or unauthorized activity and protect the integrity of our petition.

3. Document Sharing and Visibility

When you upload documents to the legal document hub, you may designate each document as Shared or Private.

  • Shared documents are visible to all verified claimants (users with claimant, board, or admin status) who are logged into the platform. By marking a document as shared, you consent to other coalition members viewing that document.
  • Private documents are visible only to you and to users with administrator access.
  • Administrator access: Coalition administrators have access to all documents regardless of visibility setting, for the purpose of moderating content, managing the platform, and coordinating with legal counsel.

You are solely responsible for the documents you upload and the visibility settings you select. Please review Section 8 (Indemnification) and Section 9 (Document Upload Disclaimer) before uploading any documents.

4. Information Sharing and Disclosure

We do not sell, rent, or trade your personal information to any third party for commercial or marketing purposes. We may share your information only in the following circumstances:

  • Legal counsel: We may share petition data, account information, and uploaded documents with attorneys retained by or in connection with the Arden Strong coalition for the purpose of evaluating and pursuing legal claims on behalf of affected homeowners.
  • Legal compulsion: We may disclose information if required to do so by law, subpoena, court order, or other valid legal process, or when we believe disclosure is necessary to comply with applicable law, protect our legal rights, or protect the safety of any person.
  • Service providers: We use Amazon Web Services (AWS) infrastructure, including DynamoDB, S3, SES, and Cognito, to store and process data. These services operate under their own privacy and security frameworks. We do not permit these providers to use your personal information for their own purposes.
  • Aggregated statistics: We may publish or share aggregated, non-personally-identifying statistics (such as the total number of petition signatures or the geographic distribution of supporters) for advocacy or public interest purposes.

We will never share your personal information with the developers of Project Tango, any landowner or builder named in coalition proceedings, or any entity affiliated with the proposed data center development.

5. Data Retention

We retain your information for as long as necessary to fulfill the purposes described in this Privacy Policy, including support of the coalition’s legal and advocacy activities:

  • Petition data is retained for as long as required for the coalition’s ongoing legal and advocacy purposes, which may extend beyond the conclusion of any administrative hearing.
  • Account data is retained until you request deletion of your account. Deleting your account will remove your authentication credentials and personal profile, but may not remove petition records already submitted to legal counsel.
  • Uploaded documents are retained unless deleted by you or by an administrator. Once documents have been shared with legal counsel, copies may be retained outside of this platform for legal purposes.
  • Communication records (contact form submissions, board applications) are retained for a reasonable period consistent with organizational recordkeeping practices.

6. Your Rights

Subject to applicable law, you have the following rights with respect to your personal information:

  • Access: You may request a copy of the personal information we hold about you.
  • Correction: You may request that we correct inaccurate or incomplete information.
  • Deletion: You may request deletion of your personal data. Please note that deletion requests may be limited where retention is required for legal compliance, defense of legal claims, or fulfillment of obligations to legal counsel.
  • Withdrawal from the coalition: You may withdraw your participation in the coalition at any time. Withdrawal does not retroactively remove information previously shared with legal counsel.
  • Opt-out of communications: You may unsubscribe from newsletter and non-essential communications at any time by clicking the unsubscribe link in any email or by contacting us at privacy@ardenstrong.org.

Arden Strong is a community advocacy organization, not a law firm. Nothing on this website constitutes legal advice. No attorney-client relationship is created by your use of this website, by signing the petition, by creating an account, by uploading documents, or by any other interaction with this platform or its organizers.

Arden Strong makes no representations, warranties, or guarantees regarding legal outcomes, the success of any petition, legal claim, or regulatory proceeding. All information provided through this website is for informational and organizational purposes only.

To the fullest extent permitted by applicable law, Arden Strong, its organizers, officers, directors, volunteers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website, your reliance on any content herein, or the outcome of any legal or regulatory proceeding, even if advised of the possibility of such damages.

8. Indemnification

You are solely responsible for the accuracy, completeness, and legality of any content, documents, or information you submit or upload to this website. By uploading a document or submitting information, you represent and warrant that:

  • You have the legal right to share, disclose, and upload the submitted content;
  • The content does not infringe the intellectual property rights, privacy rights, or other legal rights of any third party;

9. Document Upload Disclaimer

Arden Strong provides a document upload facility as a convenience for coalition members to share materials that may be relevant to advocacy and legal preparation efforts. Arden Strong does not review, verify, endorse, or take responsibility for the content, accuracy, authenticity, completeness, or legality of any document uploaded by a user.

All user-uploaded documents are provided “as-is” without any warranty of any kind, express or implied. Arden Strong disclaims all liability for any damages or losses arising from reliance on user-uploaded content by any party, including other coalition members or legal counsel.

Arden Strong reserves the right to remove any uploaded document that, in our sole discretion, violates this Privacy Policy, applicable law, or the interests of the coalition.
